Because she's held up in the air with the trident, using the trident in the water would be no issue, but in the air on the other hand...

it would be like a witch trying to use her broom while still in middair...

she could have whipped it out from under her, she is seen on land twice in the MM9 cutscenes!
just saying, you should announce that you're going to make a skin before you make it, alot of them are already being made, i believe fupoo was working on splashwoman. it might upset people if they have been working on it and then you go and finish it before them-or if that skin has already been made in the case of alien.

I believe fupoo wanted her to "walk" differently so we'll have two versions!

Edit: Also someone already made Splash woman but she had legs, which is a no no for me (unless centaur man had two legs, that would explain it).
